General Terms and Conditions (“GTC”) for booking beer seminars, courses and other events organized by Anne and Christian Temme GbR (Braustättchen am Fischmarkt / Bierothek partner dealer) (as of October 2021)

1. Scope

The following General Terms and Conditions govern the contractual relationship between participants in beer seminars, courses and other events (hereinafter referred to as “event”) (hereinafter referred to as “participants”) and Anne and Christian Temme GbR (hereinafter referred to as “Bierothek”).

2. Conclusion of contract

Registration for events can be made via the Bierothek website, by email, by phone, or in person at the Bierothek. If you register in person or by phone, the contract is concluded upon immediate confirmation of participation by the Bierothek. If you register via other channels, the contract is concluded upon separate confirmation from the Bierothek (via email or phone).

3. Cancellations and cancellation

3.1 The Bierothek expressly reserves the right to make the holding of the event dependent on an appropriate number of participants. If the event cannot be held due to insufficient participants, the Bierothek will inform the participant immediately. Cancellation due to insufficient participants will occur no later than one week before the event. In such cases, the event fee will be refunded or will not be due, or the participant will be rebooked for an equivalent event. Reimbursement of travel expenses or other event-related costs of the participants is excluded.

3.2 If the participant cancels participation in the event in whole or in part for themselves and/or other participants, the Bierothek is entitled to charge a portion of the event fee as a cancellation fee as follows:

(i) Cancellation within 14 days before the start of the event: 0% of the event fee,

(ii) Cancellation within 7 days before the start of the event: 50% of the event fee

(iii) Cancellation within 2 days before the start of the event: 75% of the event fee,

(iv) Cancellation less than 24 hours before the start of the event: 100% of the event fee.

The date of receipt of the cancellation notice is decisive. In case of non-attendance or temporary non-attendance, regardless of the reason, the full registration fee will be charged.

3.3 The participant remains free to prove that no damage has occurred or that the damage is significantly lower than that claimed by Bierothek.

4. Changes

The Bierothek reserves the right to make necessary adjustments or modifications to the content and methodology of the event, provided that these do not significantly alter the overall character of the tasting event. In the event of circumstances beyond the Bierothek's control, such as illness or other unavailability of the speaker, the Bierothek reserves the right to relocate the seminar location and/or time, substitute another speaker, or cancel the event at short notice.

5. Copyrights

All rights, including those of translation, reprinting, and reproduction of tasting materials and presentations, or parts thereof, are reserved exclusively to Bierothek. No part of the tasting materials and presentations may be reproduced in any form, including excerpts, without the written permission of Bierothek, including for educational purposes, processed, duplicated, distributed, or used for public reproduction.

6. Liability

Bierothek is liable without limitation for injury to life, limb, or health, or under the Product Liability Act. Otherwise, Bierothek's liability is limited to the breach of essential contractual obligations ("essential contractual obligations" are those necessary for the fulfillment of the contractually agreed services and on whose fulfillment the parties may therefore regularly rely); liability in these cases is limited to typical, foreseeable damages.
